Legal
Terms of Use
The rules for using Dareo. By playing, with or without an account, you accept these terms.
The essentials: 13 minimum, a real date of birth, no sexual, dangerous or hurtful content, nobody is ever forced to take a challenge, and everything can be reported. Coins are virtual items with no cash value. There is no subscription.
1. Purpose
These Terms of Use (the "Terms") set out how you may access and use the Dareo mobile application and the getdareo.com website (together, the "Service"), published by Fibroweb (see the Legal Notice). They apply to everyone who uses the Service. In these Terms, "we" and "us" mean Fibroweb, and "you" means the user.
2. The Service
Dareo is a social truth or dare game, played one on one and in real time. A match has 5 rounds. In each round, both players get the same challenge (a truth to write or a dare to complete) and discover each other's answer at the same time. You can challenge your friends with a link or a QR code, ask for a rematch, be matched with new players your age (subject to the age rules below), or play DareoBot, an automated player clearly presented as a bot.
The Service is free. It includes virtual coins, earned by playing or optionally purchased (see section 8 and our Terms of Sale). There is no subscription.
We improve the Service regularly: features may be added, changed or removed.
3. Age and account
- 13 minimum. The Service is not available to anyone under 13. Your date of birth is asked when you sign up and can't be changed afterwards: it must be accurate. Entering a false date of birth is a serious breach of these Terms.
- If you are under 18, you must have the permission of your parents or legal guardian to use the Service and to make any purchase.
- Age separation. A minor (13 to 17) never plays or chats with an adult, and the other way around, in every mode. Matches with new players and the CHAOS vibe are reserved for players 16 and up with a saved account.
- Guest or account. You can play without an account. Saving your account with Apple or Google keeps your progress and coins and unlocks some features (matches with new players, CHAOS, chat, leaderboard). Without a saved account, a guest's progress may be lost if the app is uninstalled or the phone is changed.
- One account per person. You are responsible for the activity on your account and for keeping access to your phone secure.
- You can delete your account at any time: see Delete my account.
4. Rules of conduct
Dareo must stay fun and safe for everyone. Nobody is ever forced to take a challenge: the Skip button is always available, with no justification needed. In answers, photos, messages, usernames, bios, profile pictures and link hooks, you must not:
- post or ask for sexual or sexualized content or nudity, whatever the age of the players;
- perform or push someone to perform an action that is dangerous, illegal or harmful to your health or someone else's (including alcohol, drugs and self-harm);
- harass, insult, threaten, humiliate or intimidate another player;
- post hateful, racist, sexist, homophobic or discriminatory content;
- involve another person without their consent, in particular by photographing them, or share a challenge or an answer outside the app to hurt someone;
- ask for or share personal contact details (phone number, address, email, social media) to get in touch with a minor, or try to meet a player;
- lie about your age, impersonate someone else or create several accounts;
- cheat, exploit a bug, use scripts or bots, or try to obtain coins fraudulently;
- send spam or advertising;
- post any unlawful content or content that infringes the rights of others (privacy, image rights, intellectual property);
- try to access our systems, data or other players' accounts without permission, disrupt the Service, copy it or reverse engineer it.
Our Community Guidelines explain these rules in plain words, with examples. They form part of these Terms.
5. Reporting and moderation
- Every match, answer, photo, challenge, message and profile can be reported from the app (menu or Report button). You can also block a player: they can no longer challenge you or message you.
- Reports are reviewed by our team. When an account receives three separate reports within 7 days, it is automatically suspended pending review.
- Photos you receive are blurred by default (always for minors): you choose whether to show them.
- You can also report content or behavior to contact@getdareo.com.
- In an emergency, call your local emergency number (112 in Europe, 17 in France). In France, victims or witnesses of online harassment can call 3018 (free), and unlawful content can also be reported at internet-signalement.gouv.fr (Pharos).
6. Sanctions
If you breach these Terms, depending on how serious the breach is, we may: remove the content concerned, send a warning, restrict some features (chat, links, matches with new players), suspend the account temporarily or delete it permanently. If an account is deleted for a serious breach, its coins are lost without refund, within the limits of applicable law. Manifestly unlawful content, in particular content that puts a minor at risk, is reported to the competent authorities.
If you think a sanction is a mistake, write to contact@getdareo.com with your username: we will review the decision.
7. Player content
You keep ownership of the content you post (answers, photos, messages, profile) and you are responsible for it. You only grant us the right to host it, display it to the players concerned and process it as needed to run and moderate the Service, as described in our Privacy Policy. Dare photos are deleted after 30 days.
8. Coins and purchases
Coins 🪙 are an in-game virtual currency. They are earned by playing, with the daily reward, referrals or sharing, or bought in packs in the app. They are used for bonuses and cosmetic items in the game. Coins are virtual items with no cash value: you have a personal right to use them in the game, not a property right. They cannot be exchanged for money, withdrawn, converted, transferred to another account or resold.
Coin packs are one-time in-app purchases (they never renew), billed and collected exclusively by Apple (App Store) or Google (Google Play). The rules for purchases, including prices, the right of withdrawal and refunds, are set out in our Terms of Sale.
9. Intellectual property
The app, the website, the Dareo brand, the logo, the challenges, texts, illustrations and code are protected by intellectual property law and remain the property of Fibroweb or its partners. You receive a personal, non-exclusive and non-transferable right to use them, limited to the normal use of the Service. For iPhone users, Apple's standard Licensed Application End User License Agreement (EULA) also applies.
10. Availability and liability
We do our best to keep the Service available and reliable, but we can't guarantee it will always be available: interruptions may happen for maintenance, updates or technical incidents. You alone are responsible for how you complete a challenge: never do anything that makes you uncomfortable or puts you at risk. To the extent permitted by law, we are not liable for indirect damage, misuse of the Service or temporary unavailability. Nothing in these Terms limits the rights you have under mandatory consumer protection rules, in particular the legal guarantee of conformity for digital content and services.
11. Termination
You can stop using the Service and delete your account at any time. We may suspend or delete an account under the conditions of section 6. If we ever had to shut down the Service permanently, we would let you know in advance in the app.
12. Personal data
How we process your data, including the protections in place for minors, is described in our Privacy Policy.
13. Changes to these Terms
We may update these Terms. If we make a significant change, we will let you know in the app before it takes effect. Continuing to use the Service after that date means you accept the new Terms.
14. Governing law, mediation and disputes
These Terms are governed by French law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of your country of residence. If there is a problem, please contact us first at contact@getdareo.com: we will look for an amicable solution.
If you are a consumer and no solution has been found, you can use the following consumer mediator free of charge: TO COMPLETE: name, website and address of the consumer mediator. Failing an agreement, the dispute will be brought before the competent French courts, without prejudice to the jurisdiction rules that protect consumers.
